Citizen Advisory Committee – September 4, 2024: Amendments to the Comprehensive IGAs with All Six Member Governments

MEMORANDUM

DATE: September 4, 2024

TO: Pikes Peak Rural Transportation Authority Citizen Advisory Committee

FROM: Rick Sonnenburg, Program/Contracts Manager

SUBJECT: Amendments to the Comprehensive IGAs with All Six Member Governments

ACTION REQUESTED: Recommendation

Since the inception of the Pikes Peak RTA, there have been a set of intergovernmental agreements between the PPRTA and each of the member governments called Comprehensive IGAs.  These are a separate set of IGAs from the Establishing IGA, which was approved by the initial four member governments in 2004 in advance of the November 2004 ballot measure which the voters approved to establish the PPRTA starting on January 1, 2005.  The original Comprehensive IGAs for the founding four member governments were enacted effective January 1, 2005.  The Comprehensive IGAs with Ramah and Calhan were enacted in the year they joined the PPRTA.

The primary elements contained in the Comprehensive IGAs are details for the following subjects:

  1. Budget submittal process
  2. Claims handling process
  3. Stipulating that each member government uses its own contracting process to select the vendors it recommends to the CAC and Board for approval.  Also, requiring that all contracts submitted to the PPRTA for approval must be 3-party contracts between the member government, the vendor, and the PPRTA.  A new feature is the mention of Board Policy #30 which contains contracting details for approval items and information items and replaces previous generic wording.
  4. Warranties must name the PPRTA as a beneficiary
  5. Stipulates that the PPRTA does not own any property or facility
  6. Member governments must submit quarterly reports to the PPRTA
  7. PPRTA will honor member governments’ records requests
  8. Member governments shall not be allowed to require the PPRTA to pay any compensation to any member government or any member governments’ personnel for any services
  9. List of the PPRTA-1 and PPRTA-2 Capital projects.  The new item is the list of the PPRTA-3 Capital projects.

All the elements listed above have remained the same since each Comprehensive IGA was first drafted except for the mention of Board Policy #30, which is a relatively recent Policy approved by the Board, and the list of the PPRTA-3 Capital projects.

RECOMMENDATION TO THE COMMITTEE:

The PPRTA staff recommends that the CAC approve separate motions to the Board recommending approvals of the Amended Comprehensive IGAs with all six member governments.
